General Conditions
Article 1: Definitions
1.1. In these standard terms and conditions, the following
definitions apply:
a. Event: the CPC Run The Hague running event organised by
SportMarketing Consultancy B.V. (Trade Register no. 24314794) in
any given year.
b. Participant: the individual who has registered to participate in
the Event in a manner permitted by the Organiser.
c. Agreement: the agreement covering participation by the
Participant in the Event.
d. Organiser: the legal person with which the Participant enters
into an Agreement.
1.2 These standard terms and conditions apply to every
Agreement.
Article 2: Participation
2.1. Participation in the Event is open only to
individuals who have reached the minimum age stipulated by the
Organiser for the Event.
2.2 The Participant may participate in the Event only if he/she has
filled in the required registration form fully and truthfully, if
the registration fee has been paid in full, and if the participant
has agreed to the standard terms and conditions.
2.3 The Participant shall participate in the Event in person. It is
therefore not permissible for another person to participate in the
Event instead of the Participant.
2.4 The Participant is not permitted to transfer his/her rights
arising from the Agreement to a third party without the prior
written approval of the Organiser.
2.5 If the Participant is unable to participate in the Event, the
registration fee that has been paid will not be refunded. There
will also be no refund of the registration fee in the event of a
change in the distance for which the participant is registered. If
a T-shirt that has been ordered and paid for is not collected on
the day of the Event, all rights to that T-shirt will lapse. No
other payments made on the basis of the Agreement will be refunded
either.
2.6 The Organiser may decide that due to exceptional circumstances
the Event will not go ahead. The Participant will then be given the
opportunity to participate in the same edition of the Event on a
substitute date. If the Organiser does not set a substitute date,
the Participant will be given the opportunity to take part in a
subsequent edition of the Event. There will be no refund of the
registration fee in either case, not even if the Participant is
unable to participate on the substitute date or on the date of the
subsequent edition. If no substitute date is set and no subsequent
edition is organised, the registration fee will be refunded subject
to the deduction of an administration fee of 25%.
2.7 The Organiser is not liable for costs incurred by the
Participant if the Event has to be cancelled for reasons of force
majeure.
Article 3: Liability
3.1 Participation takes place at the Participants own
risk. The Organiser is not liable for any loss, however it is
described, that the Participant may incur as a consequence of
Participation, unless that loss is the direct consequence of intent
or gross culpability that is attributable to the Organiser. This
exclusion of liability also applies to serious forms of loss, such
as all possible kinds of loss resulting from injury or death.
3.2 If, despite the provision contained in the first paragraph of
this article, the Organiser must be assumed to be liable for the
losses of the Participant, the Organiser's obligation to compensate
those losses will be limited to no more than the amount that the
Organiser's insurer pays out in relation to those losses.
3.3 The Participant must be sufficiently insured against the risk
of the losses that he/she or a surviving relative may incur as a
result of his/her death, injury or sickness resulting from his/her
participation in the Event.
3.4 The Participant declares that he/she is aware that
participation requires good health, both mentally and physically,
that he/she complies with this requirement and that he/she has
prepared sufficiently for the Event by means of training and
otherwise. The Organiser expressly urges the Participant to undergo
a sport-medical examination in connection with participation in the
Event.
3.5 The Participant indemnifies the Organiser against any losses
that third parties may incur resulting from any act or omission
attributable to the Participant in relation to the Event. The
Participant must be sufficiently insured against the risk of
liability for such losses.
3.6 Sponsors of the Event and the municipality or municipalities in
the which the Event takes place are excluded from liability on the
same basis as the Organiser.
Article 4: Portrait Right
The Participant grants consent to the Organiser in advance
for the publication of photographs, images etc, taken/made during
or in connection with the Event, in which the Participant is
visible.
Article 5: Personal Data
The personal data provided by the Participant will be
stored in a file by the Organiser. By entering into the Agreement
the Participant grants consent to the Organiser for the use of the
personal data to send information to the Participant and for the
passing on of that personal data to third parties for the purpose
of sending information to the Participant. The Participant may at
any time object in writing or by e-mail to the sending of
information by the Organiser or to the passing on of personal data,
following which the Organiser will desist from sending or passing
on the data. By entering into the Agreement the Participant grants
consent to the Organiser for the publication of his/her name and
competition results, for instance by means of publication in
newspapers and on the internet.
Article 6: Resolution of Disputes
Disputes between the Organiser and the Participant shall,
to the exclusion of the civil courts, be resolved by arbitration in
accordance with the arbitration regulations of Atletiekunie (Dutch
Athletic Federation) or, in the absence thereof, the regulations of
the Dutch Arbitration Institute. A dispute shall be deemed to
exist if one of the parties declares this to be the case.
Article 7: Competition Regulations
Participation in the Event by the Participant shall be
governed by the Fortis City-Pier-City Run Competition Regulations,
which form part of these standard terms and conditions, in the
understanding that the provisions of i. to k. incl. apply only to
participation in sections where times are recorded and the
provisions of l. t/m n. incl. apply only to the Dutch Championchip
Half Marathon section.
In the event of differences in translation or interpretation
between the Dutch and the English version of this document, parties
will be bound to the Dutch version which prevails.
